The PERM regulation remains pending at the Office of Management and Budget (“OMB”), and it is widely thought that, if it moves at all, it will not be published until after the election.

It is also believed that some key changes have been made from the proposed rule.

The PERM regulation will take effect 120 days after publication of the final regulation in the Federal Register.

The PERM program, once implemented, will replace traditional and Reduction in Recruitment (“RIR”) labor certification processing. Once PERM goes live, applications will no longer be accepted under RIR or the traditional process.

Employers may continue to file both RIR and traditional labor certification applications until the PERM program is implemented.
